Article 1 Definition of Terms
- 1.“Exhibitor” refers to a company, organization, or individual who has submitted an application for participation in this exhibition.
- 2.“Exhibition” refers to the “24th Busan International Food Expo.”
- 3.“Organizer” refers to “Busan Metropolitan City, Busan Metropolitan City Branch of Korea Restaurant Association.”
Article 2 Application for Participation
- 1.Anyone wishing to participate in the exhibition must fill out the application form and submit it to the organizer.
- 2.Exhibitors must pay the full participation fee within two weeks of the invoice issuance after submitting the participation application form.
- 3.If there are any changes to the contents of the application for participation or other submitted documents, the exhibitor must immediately notify the organizer. The exhibitor is responsible for any disadvantages resulting from failure to notify.
Article 3 Payment of participation fee
- 1.The basic participation fee is 1,800,000 won (excluding VAT) per booth for an assembled booth.
- 2.Exhibitors must pay the participation fee related to facility usage fees immediately after the invoice is issued.
- 3.If an exhibitor fails to pay the participation fee, technical support fee, and other fees, the organizer may selectively retain the exhibitor's exhibits until full payment is made.
- 4.Exhibitors may suffer disadvantages if they disclose information about participation fees to a third party.
Article 4 Details of participation fees
- 1.The participation fee includes the exhibition venue, exhibition operation, promotion, exhibition hall security and guard, etc. However, the fee for use of auxiliary facilities is separate.
Article 5 Allocation of exhibition area
- 1.The organizer will assign exhibition locations to each exhibitor based on the order of application, application area, nature of exhibits, and other reasonable methods, and exhibitors may not raise objections.
- 2.In special circumstances, the organizer may change the exhibition location and area assigned to the exhibitor prior to the exhibition setup period through consultation with the exhibitor, and the exhibitor must cooperate with the organizer's requests to the greatest extent possible, except in cases of force majeure.
Article 6 Installation and removal
- 1.Installation and dismantling must be completed within the period specified by the organizer, and the exhibitor must compensate the organizer for any loss or damage to the exhibition hall resulting from delay.
Article 7 Provision of information to the organizer
- Exhibitors must provide the organizer with information regarding exhibits and exhibition construction, as well as information necessary for the promotion of the exhibition, so that the organizer can determine whether the booth equipment and activities comply with the regulations.
Article 8 Exhibition Booth Management
- 1.Exhibitors must display the exhibits specified in the application for participation and assign permanent staff to manage their booths.
- 2.If the exhibitor exhibits items that are different from those specified in the participation application or items that do not fit the nature of the exhibition, the organizer may immediately order the exhibition to be stopped, removed, or removed. In this case, the participation fee will not be refunded and the exhibitor cannot claim compensation for this.
- 3.The organizer may restrict the entry of certain individuals into the exhibition hall if necessary. Exhibitors may not transfer, resell, or exchange all or part of the assigned exhibition space to others without the written consent of the organizer.
- 4.Exhibitors may not paint, nail, or otherwise alter the floor, ceiling, pillars, or walls of the exhibition hall. Exhibitors must provide appropriate compensation for damage to the exhibition hall upon request from the organizer.
- 5.The organizer may selectively exclude or restrict exhibition items, exhibition acts, etc. in order to maintain order, manage safety, and prevent acts that may cause social controversy.
- 6.Exhibitors must remain in the booth for the designated period of time. In unavoidable cases, this must be done in consultation with the secretariat.
Article 9 Exhibition Hall Security, Risks and Insurance
- 1.The organizer will take appropriate security measures for exhibitors and visitors.
- 2.The exhibitor shall be fully responsible for any damage or theft to the fixtures and exhibits within the allocated area during the exhibition period and during the installation and dismantling periods.
- 3.If the exhibitor intentionally or negligently causes fire, theft, damage or other accidents, causing damage to the organizer or others, the exhibitor shall be fully liable for compensation, and the exhibitor shall also be responsible for taking out insurance for the exhibits, etc.
Article 10 Legal Rights of Exhibits
- 1.Exhibitors must comply with legal responsibilities regarding exhibits, including patent rights and property rights.
- 2.If you wish to sell, you must notify the organizer and submit relevant documents when applying for exhibition participation. Exhibitors may only sell products for which they have legal rights, and are legally responsible for customer service and after-sales service related to on-site sales.
Article 11 Fire Prevention Rules
- 1.All equipment and materials within the exhibition hall must be properly fire-retardant in accordance with fire regulations.
- 2.The organizer may, if necessary, request the exhibitor to take corrective action regarding fire prevention.
Article 12 Cancellation or change of exhibition
- If the organizer cancels the exhibition, the entire participation fee already paid will be refunded to the exhibitor. However, if the exhibition is canceled, the opening date is changed, or the exhibition is shortened due to force majeure or other special circumstances not attributable to the organizer, the fee will not be refunded. In this case, the exhibitor cannot claim compensation from the organizer.
Article 13 Cancellation of participation and reduction in scale
- 1.If the exhibitor refuses to use the assigned exhibition booth or fails to pay the participation fee by the deadline, the organizer may unilaterally terminate the participation contract, and in this case, the paid participation fee will not be refunded.
- 2.If the exhibitor cancels the use of all or part of the exhibition space agreed upon, the exhibitor must immediately notify the organizer in writing of the cancellation.
- 3.If the exhibitor cancels or reduces the scale of participation after submitting the participation application and contract, the exhibitor must pay the organizer the equivalent of the cancellation fee specified below within 5 days of the cancellation. All cancellation fees do not include VAT, and no tax invoice will be issued.
- - In case of cancellation by August 15, 2024: 50% of the participation fee (facility usage fee) or reduced amount will be paid as a penalty.
- - In case of cancellation after August 16, 2024: 100% of the participation fee (facility usage fee) or reduced amount will be paid as a penalty.
- 4.No interest will be paid on the refund amount.
Article 14 Supplementary Provisions
- The organizer may, if necessary, establish supplementary regulations not specified in the participation agreement, and such supplementary regulations shall become part of the participation agreement. Exhibitors must comply with these.
Article 15 Dispute Resolution
- Any disputes regarding the rights and obligations of the parties arising from the interpretation of this Agreement shall be subject to the arbitration decision of the Korean Commercial Arbitration Board, and such decision cannot be brought to court.
